I did not agree with it. The same course has been pursued on other occasions in which Police objections have been raised. Upon my signing the permit, the petitioner was then at liberty to go on with the scaffolding. I cannot tell where I get my authority from the Governor to sign permits. Section XX11 of Order 8 of 1858 empowers licenses to be granted for Religious and Theatrical entertainments under the hand of the Governor. That was the authority in this case. I may mention that last year a similar complaint was made but after the permit had already been signed by the Acting Capt. Supt of Police. Last year they had permission to play all night, but this year I altered the time to 1 o'clock.
Though I cannot point to the authority given to me, I nevertheless say that it has been the constant practice for years. I decline to answer whether the Order of the Governor General is in particular terms or not. He did not specially authorize me to sign in this particular instance; it is a standing Order. I do not know whether I can lay hands upon it at this time.
